En signant un bail, ils s\u2019engagent \u00e0 payer le loyer et assument ensemble les diff\u00e9rentes responsabilit\u00e9s.<\/p>\n<p><strong>2.\u00a0Les avantages de partager un appartement<\/strong><\/p>\n<p>Les avantages financiers \u00e0 signer un bail de colocation pr\u00e9sentent de nombreux avantages, comme le partage du loyer et le fractionnement des d\u00e9penses (chauffage, \u00e9lectricit\u00e9, internet, etc.). Vous pourriez aussi \u00e9ventuellement vivre dans un logement plus grand ou mieux situ\u00e9, tout en b\u00e9n\u00e9ficiant d&rsquo;une aide pour les t\u00e2ches m\u00e9nag\u00e8res. Ces avantages sont tout aussi valables si vous d\u00e9cidez d&rsquo;<a href=\"https:\/\/www.centris.ca\/fr\/blogue\/immobilier\/devrais-je-acheter-une-maison-avec-des-amis\">acheter une maison entre amis\u00a0<\/a>!<\/p>\n<p><strong>3.\u00a0Obligations des colocataires<\/strong><\/p>\n<p>Les colocataires doivent se conformer aux obligations \u00e9nonc\u00e9es dans le bail, notamment :<\/p>\n<p>Payer le loyer selon les modalit\u00e9s<br \/>\nUtiliser l&rsquo;appartement de mani\u00e8re responsable<br \/>\nRespecter la forme ou la destination du logement lou\u00e9<br \/>\nSe comporter de mani\u00e8re \u00e0 ne pas perturber la jouissance de l\u2019immeuble par les autres locataires<\/p>\n<p>Si un colocataire ne respecte pas ses engagements, le propri\u00e9taire peut exercer ses droits aupr\u00e8s du <a href=\"https:\/\/www.tal.gouv.qc.ca\/en\/\">Tribunal administratif du logement<\/a>, tout comme il le ferait pour une situation similaire impliquant un seul locataire.<\/p>\n<p><strong>4.\u00a0Obligation solidaire\u00a0: Vos droits en tant que colocataire<\/strong><\/p>\n<p>Les colocataires sont tenus de payer le loyer conjointement. En d\u2019autres termes, chacun doit payer sa part selon les termes convenus dans un accord de colocation. Cependant, le bail comporte parfois une clause de solidarit\u00e9, c&rsquo;est-\u00e0-dire que chaque personne peut \u00eatre poursuivie individuellement pour la totalit\u00e9 du loyer.[2] Si cette clause n&rsquo;est pas pr\u00e9cis\u00e9e dans le bail, il existe une obligation solidaire de paiement, sauf si les colocataires sont mari\u00e9s.<\/p>\n<p>En tant que colocataire, vous disposez d&rsquo;un recours contre votre colocataire s&rsquo;il ne respecte pas l&rsquo;entente. Pour conna\u00eetre vos droits, contactez le Tribunal administratif du logement.<\/p>\n<p><strong>5.\u00a0Signer un bail\u00a0: une protection essentielle<\/strong><\/p>\n<p>Le bail d\u00e9termine les conditions dans lesquelles une r\u00e9sidence est occup\u00e9e. Dans le cas d&rsquo;une copropri\u00e9t\u00e9, le propri\u00e9taire doit transmettre l&rsquo;avis d&rsquo;augmentation de loyer ou de toute autre modification au bail \u00e0 chacun des colocataires.[2] En effet, chaque colocataire dispose d&rsquo;un droit individuel au maintien dans les lieux et peut d\u00e9cider d&rsquo;accepter ou non les nouvelles conditions.<\/p>\n<p>Si un colocataire souhaite c\u00e9der sa part du bail ou sous-louer le logement, il doit en informer par \u00e9crit son(ses) colocataire(s) et le propri\u00e9taire pour obtenir leur consentement.<\/p>\n<p>Pr\u00eat \u00e0 louer un appartement partag\u00e9\u00a0?
